Rite Aid Locations Closing in California Due to Bankruptcy- What You Need to Know

Rite Aid, one of the largest pharmacy chains in the United States, is closing hundreds of locations after filing for Chapter 11 bankruptcy.  However, the Rite Aid bankruptcy filing is a rising trend in business and personal bankruptcy filings. In the post-COVID-19 era, there was a dramatic surge in business bankruptcies, and the trend continued in 2024. As we look to the future, it is crucial for consumer debtors to be informed about the statute of limitations in their state to protect themselves.

In 2023, we have already witnessed a substantial spike in bankruptcy filings for businesses and consumers. The amount of bankruptcy filings for businesses has increased by seventy-two percent. I wrote about this issue recently. You can find that article via this link.

Pharmacy giant Rite Aid is one of those large corporations that is currently in Chapter 11 bankruptcy. This has resulted in the closing of a substantial amount of locations in an attempt to remain profitable as they attempt to recover from opioid-related lawsuits. The store locations closing in California are listed below.

Consumer Bankruptcy Cases- Chapter 7 and Chapter 13

Bankruptcy has steadily increased for individual debtors as well. An increase nationally of sixteen percent. I always believed that for consumers, there would be a spike in bankruptcy cases filed between 2024 through 2025, because of the effects of COVID-19 and creditors seeking to file claims before the statute of limitations runs out.

What is the Statute of Limitations

The statute of limitations is the time frame in which a lawsuit has to be filed. If a lawsuit is not filed within the time frame of the statute of limitations, then the lawsuit will not be valid and will be dismissed by the court.

For example, say in your state, the statute of limitations on a civil lawsuit to collect on debt is five years. And let’s say during that time frame, your car was repossessed. If the creditor tries to collect on the debt of the vehicle, the lawsuit would have to be filed within five years of the car being repossessed.

However, the statute of limitations could be extended if payments are made during this timeframe. For example, a common tactic by creditors who are trying to collect on an old debt that passed the statute of limitations is to contact a debtor and say to avoid a lawsuit; they are willing to give you more time and make payment arrangements if you make a payment in good faith.

In this case, the debtor, to end the harassing phone calls from creditors, makes a payment on that old debt. The consequence is that the five years start all over again, giving the creditor another five years to pursue collections.

So it’s important to regularly review your credit report to know how old your debts are. You are entitled to a free credit report every 12 months per the Fair Debt Collection Practices Act. You can try annualcreditreport.com, which provides your credit report from the three major reporting bureaus: Experian, Equifax, and Transunion.

Updated: Rite-Aid was able to get out of bankruptcy in September of 2024, but has since refiled for Chapter 11 bankruptcy.
