Arizona Bankruptcy Trustees: Roles and Responsibilities
Understanding the role of bankruptcy trustees is crucial when navigating the bankruptcy process in Arizona. Bankruptcy trustees are private individuals, not to be confused with the United States Trustee, which is a government employee and part of the Department of Justice.
Trustees work on a bankruptcy case from beginning to end and are responsible for protecting the bankruptcy estate, which is all the assets of the debtor. For example, if assets are transferred fraudulently, the bankruptcy trustee has the power to sue the individuals who now have the assets to protect the estate.
Who Are Bankruptcy Trustees?
Bankruptcy trustees are court-appointed. Their assignment to cases is random. However, for Chapter 13 cases, there is typically one trustee known as the “standing trustee.” The trustee will review the bankruptcy petitions to ensure accuracy and completeness. This is done at the 341 meeting of creditors.
How to Work with the Arizona Bankruptcy Trustees
If you’re considering filing for bankruptcy in Arizona, it’s important to be transparent and provide all requested information promptly. Upon the bankruptcy trustee being appointed to the case, they will provide a list of documents that are needed prior to the 341 creditors’ meeting. Generally, these documents are required ten days in advance of the hearing.
If you have a bankruptcy lawyer, make sure to provide these documents in advance to avoid any delays in your case.
