Your Guide to Bankruptcy Trustees in Connecticut
The Connecticut bankruptcy trustee is automatically appointed to manage the process from start to finish when a new case is filed.
In Chapter 7 cases, the trustee evaluates the debtor’s assets to identify which are exempt or protected and supervises the sale of any nonexempt property. Generally, the debtor interacts with the trustee only once, during the 341 meeting of creditors. If the debtor hired a bankruptcy attorney, the attorney will also be present at the 341 meeting.
At this meeting, the trustee asks basic questions about the bankruptcy petition. I recommend arriving early to observe other hearings, which can help prepare for your own hearing. Post-COVID-19, the hearing is likely to be held remotely by phone. If so, you can listen in on other hearings since they are open to the public. So you can listen well in advance of your hearing. There is usually information posted on the bankruptcy clerk’s website that provides any passwords needed to dial into the hearing.
For Chapter 13 Cases, the bankruptcy trustee reviews the debtor’s proposed repayment plan and plays an active role in hearings, including the 341 meeting and the Confirmation Hearing. They also address any motions filed during the case. Beyond court proceedings, the trustee is responsible for collecting monthly payments from the debtor and distributing them to creditors as outlined in the repayment plan.
