Hawaii Bankruptcy Trustees: Their Roles and Contact Information
The Hawaii Bankruptcy Trustees play a crucial role in overseeing the bankruptcy estate, which includes all of the debtor’s assets. In the Aloha State, bankruptcy cases are administered by three designated trustees: two for Chapter 7 and one for Chapter 13.
A distinction exists between exempt assets, which are protected by law and kept by the debtor, versus non-exempt assets, which are subject to liquidation to pay creditors. The Hawaii bankruptcy trustee is responsible for identifying and managing these nonexempt assets to ensure a fair outcome for the creditors.
The Hawaii bankruptcy trustee is also responsible for administering the case from start to finish. This includes the 341 Meeting of Creditors, where the debtor’s financial disclosures are reviewed, and any concerns from creditors are addressed. If fraud is suspected, the trustee has the authority to take legal action to recover assets and preserve the integrity of the estate.
Chapter 7 vs. Chapter 13 Trustees
In Chapter 7 cases, the trustee’s focus is on liquidating non-exempt assets, whereas in Chapter 13, the trustee oversees the debtor’s repayment plan. It’s important to distinguish the bankruptcy trustee, a private individual administering your case, from the Office of the U.S. Trustee, a Department of Justice entity that supervises bankruptcy trustees to ensure compliance with their obligations.
