U.S. Bankruptcy Court: District of New Mexico
The U.S. Bankruptcy Court for the District of New Mexico serves the entire state. While the physical Clerk’s Office is located in Albuquerque, the court holds hearings in multiple cities, including Las Cruces, Roswell, and Santa Fe.
While in-person filing is an option, it is highly recommended that you utilize the court’s online systems. Attorneys use CM/ECF, while pro se debtors or self-represented parties are encouraged to use the eSR (Electronic Self-Representation) system. Federal Bankruptcy Judges
The District of New Mexico bench is centralized but mobile, with judges often presiding over hearings via video or traveling to various divisions.

Due to Judge Thuma’s passing, all cases have been transferred to Judge Jacobvitz. At this time, there has not been a new judge appointed.
The Professor’s Tip: In the District of New Mexico, judges frequently use “ChapMobile“ to publish their hearing calendars. Always check the “Judges’ Information” section on the official court website to see if your specific judge requires original signatures on certain documents or has specific requirements for telephonic appearances.

The Clerk of Court’s office is the central intake point for the state:
Albuquerque (Main Office)
- Location: Pete V. Domenici U.S. Courthouse, 333 Lomas Blvd. NW, Suite 360, Albuquerque, NM 87102.
- Note: You must present a photo ID and pass through security at the main entrance on the south side of the building.
Counties Served in New Mexico
Because New Mexico is a single district, the venue is straightforward. However, for the purpose of scheduling your 341 Meeting of Creditors, the court generally groups cases by regions:
- Albuquerque/Northern Region: Serves Bernalillo, Santa Fe, Sandoval, and surrounding northern counties.
- Las Cruces/Southern Region: Serves Doña Ana, Luna, and Hidalgo counties.
- Roswell/Eastern Region: Serves Chaves, Eddy, and Lea counties.
Local Bankruptcy Rules & Resources
As I discuss in Consumer Bankruptcy Law (Routledge) as well as Bankruptcy.blog, understanding the “local culture” is imperative. Practices in the 10th Circuit often differ from those in other circuits, especially regarding local forms for Chapter 13 plans.
For example, in my district, the Southern District of Florida, I’ve never faced an issue with the trustee objecting to 401(k) withdrawals. Still, in researching other states, some trustees object to any amount withdrawn.
